With this document we provide you with information on the processing of personal data performed by RESIDOMO, s.r.o., company ID 05253268, tax ID CZ699002915, registered at the Regional Court in Ostrava under file No. C.66812, registered office Gregorova 2582/3, Moravská Ostrava, 702 00 Ostrava (hereinafter referred to as “RESIDOMO” only). This document defines the extent of personal data we process, the purposes, based on what legal title, for how long RESIDOMO processes your personal data, with whom and for what reason we may share your data, including your rights related to the processing of personal data.

We want to assure you that we process your personal data with due care and in accordance with the applicable law. We protect your personal data to the maximum possible extent while ensuring their confidentiality and integrity by applying organizational and technical measures that are constantly updated and modernized.

This personal data processing policy (hereinafter the “Policy” only) applies to the processing of personal data of RESIDOMO clients, tenants and lessees (i.e. entities which entered into any contractual relationship with RESIDOMO), and to persons sharing leased properties and tenant's family members, including children. Personal data of children (persons under 15 years of age) are processed only with the consent of their parents or other guardians who may decide whether providing personal data of a child is in conflict with the child’s interests or contrary to legitimate interest.

  

Personal Data Administrator

RESIDOMO is your data administrator and collects your personal information and data for the purposes listed below.

Data administrator collects, possesses and is responsible for proper and lawful processing of your data in accordance with the relevant Regulation and applicable data protection laws.

You may claim your rights defined further below related to personal data protection at the Data administrator.

Concluding a contractual relationship, negotiating a product or service

If you enter into a lease contract with RESIDOMO, or arrange for another service or product, you pass on to us basic personal data and, depending on the nature, also other information or data necessary for us to enter into a contract with you, and to determine if we are able to offer you a product, service or contract. Your personal information is managed by the product provider. Therefore, if the relevant service is offered to you by a third party, then the third party is the administrator of this information.

In order for us to conclude a lease or rental contract and to be able to properly select a contractual partner, and due to other reasons (e.g. assessment of the possibility to receive a subsidy or housing contribution), we also need to process your profile information including profile data of persons sharing the leased space with you in order to determine the creditworthiness of all residents. We process this data only to the extent necessary and only for the necessary time (i.e. usually only until the conclusion or non-conclusion of the lease contract).

Performance of contractual relationship

During the term of the lease we may encounter various life situations where we need to process your personal data within the extent that you have provided and specified during the conclusion of our contractual relationship, or data which needs to be supplemented, corrected or added (for example when your personal data are modified). For example, in order to properly set up your payments, you need to inform us about residents who share the household with you. We process the personal data of these persons to the necessary extent and scope.

Client Service

In order to properly perform our services, to make basic information available, and to propose solutions to your life situations, we send you reports, information and updated measures to help you make the most of your rights defined in the contractual relationship. These messages are sent out in different forms including regular mailing, telephone, SMS, fax, e-mail, the Internet, through client portals, mobile applications, social media, or through RESIDOMO Magazine.

You communicate and negotiate with us

We respect your needs and preferences throughout the duration of the contract. To help you choose the best service and product, we need a complete overview of what services you use and what you want. We deal with your suggestions, requests and complaints through our client centres, customer hotlines, websites, mobile applications and other ways that we continually expand, refine, accelerate and make accessible. We want to know if you are satisfied with our services and other products related to housing or if you have suggestions how to improve our services.

Whether you communicate with us electronically, in writing, by telephone, or during a personal visit, we collect personal information while communicating with you. When communicating with you, either in person or electronically, it is usually necessary for us to ask for your identification. In order to communicate with you electronically, we process your access data, especially your username and password, which are used for secure identification and authentication.

We only process personal information so that we can provide you with quality and professional and comfortable service, to comply with our legal obligations and to protect our legitimate interests. We collect data mainly about our clients or clients who are interested in our services and approached us.

We process your basic personal information without which we would be unable to conclude a contract with you, including data about the products and services you use, data related to our communications as well as other data to make sure that the range of information is adequate, relevant and limited to the extent necessary for the purpose for which we collect and process your personal information.

Personal Identification Data

The basic identification data include your name, surname, date of birth, academic title, identity card number (identity card or passport), permanent address, address of residence or temporary residence, or other contact address, nationality, depiction of your signature, and if you are conducting business activities then also your company ID and VAT number and company registered address.

Usually, your identification information is a part of the contract you conclude with us.

Contact Information

Your contact details include your telephone number, e-mail, or your social profile address and your employer. Contact information is used mainly to manage communication with you and to be able to provide services and products in a comfortable manner.

In order to use our applications and communicate with us electronically, we also handle your access information/data - in particular, your login name, password, authentication certificates and other security features so that we can safely identify you in electronic communication.

Data on services used

We also process information about the services and products you require. Based on the above, we record our mutual communication including previous offers and recommendations.

In relation to the services we use, we keep track of your transactions, i.e. payment information, bank account numbers, your earnings and potential interest in provided services.

We also keep track of the electronic devices you use to access our services including information from your Internet browser, your IP address, information from your Internet browser, cookies used in our site, location and geolocation information, your identifiers in social networks and communication platforms.

In connection with the services and products used, we also evaluate related personal information (e.g. your consumer preferences, the extent of services and products used, etc.).

The information collected helps us in particular to facilitate and speed up service provided to you and to improve the quality and complexity of services including optimization of the relevant services.

Profile data

We also process your basic physical characteristics such as your gender, age, socio-economic situation (e.g. expense structure and spent amounts), socio-demographic characteristics (marriage/partnership, number of children, level of education, employment, housing and household information), life style information (e.g. habits, leisure), significant milestones (relocation) and risk data (creditworthiness and risk assessment). This profile information allows us to offer you services that suits your needs and to ensure proper performance of our part of the contract.

In order to be able to provide you with housing service in RESIDOMO apartments and houses, we verify your creditworthiness and credibility and assess the relevant risks, and record your payment history.

Personal Information of Room-mates

In order to set the correct amount paid for our services, it is necessary that we also process personal data of persons who live with the tenant in the apartment and who are not in a contractual relationship with us (Room-mates). In order to improve the quality of housing and the services provided, we also offer the opportunity to use our special products to your room-mates. For this reason, we must also process their personal data within the extent of their contact information, data on services used, profile data and other information. We are also obliged to process some of these personal data based on the contract performance, and some data are processed on the basis of a consent with the processing of personal data.

Additional Information

With regard to social responsibility and due to the public interest in the field of public health, and in order to be able to offer adequate services to people with disabilities or seniors, we also process personal data related to these issues. Based on this we are able to provide you with services that are particularly specific and comfortable for you.

For security reasons and due to property and health reasons, some of our premises (apartment buildings or client centres) are monitored by a video surveillance system. To further improve our services, some phone calls are monitored. In this respect, your data are processed in the form of the relevant video recording depicting you including the audio recording of your voice. Cameras are operated and recorded data are processed on behalf of RESIDOMO by a third party.

To continually improve our contractual and other related services, we process data from our communications and interactions that you shared with us.

 

Purpose of Personal Data Processing

We process your personal data within the necessary extend and to fulfil the relevant purpose - for example, to enter into a lease agreement with you, to fulfil this contract, or to provide you with related services.

The obligation to process your personal data is imposed on us by a number of legal regulations. Many data must be processed for archiving purposes. Certain data are processed in order to protect the rights and legal interests of RESIDOMO as well as rights of third parties. Therefore, we carefully assess processing of personal data. Otherwise, we only process your personal data based on your consent.

Distribution of RESIDOMO magazine

RESIDOMO magazine is usually distributed as non-targeted distribution and in doing so, no personal data are processed.

Direct distribution is carried out where it is not possible to deliver the RESIDOMO Magazine into mailboxes - in areas where houses owned by RESIDOMO are located (usually stand-alone family houses), or rather to those entities that have given consent to the Administrator to process personal data.

In order to perform data analyses, statistical calculations, and analytical models we combine, compare, and analyse service data and profile data which allows us to accurately estimate and then meet the needs of selected categories of subjects or entities. Data used in analysis, statistical calculations and models are examined anonymously and we do not target any particular subjects.

Protection of RESIDOMO, s.r.o. asset and third parties including protection of safety, life and health, prevention of crime, prevention of vandalism, prevention of entry of undesired persons and protection of life and health of persons (especially through CCTV system)

In order to protect property, safety, life and health, to prevent vandalism and entry of undesired persons, and to ensure a secondary security system in case of disruption of the primary security systems, some apartment buildings of the administrator, client centres and other areas are monitored by CCTV recording system. CCTV systems are installed in such way that they do not interfere with privacy but above all they protect the property of the Administrator and the property of residents and third parties and finally, they also provide security. The CCTV system is operated on behalf of the Administrator by a third party.

Cookies use various web traffic statistics and other measuring systems that store the visitor's ID, the time, where the visitor came from, what keyword was used (e.g. after a Google search), etc. We are interested in the fact whether users visit and re-visit our website, so we collect traffic statistics to develop and further improve our site based preferences of users who keep visiting our site.

We use Google Analytics, ChartBear, and Netmonitor to measure web traffic. These measurements show us which pages provided on the website the user has visited, how the users found out about our page, where they came from, where they headed after leaving our site, what devices they used, the operating system or browser, or what language they prefer. These statistics are completely anonymous, so we do not know which specific user has visited the site. We do not associate the data collected with any other data, and manage cookies in a certain way so that it is not possible to identify any specific subject.

 

How long do we keep your personal information?

We only store your personal information for the period that is necessary to fulfil the purposes for which your data are processed. The usual archiving time is 10 years, as imposed on us by law.

If several categories of personal data are processed and certain categories of data are no longer necessary for the fulfilment of the above-mentioned purposes, we delete these data immediately, or we “anonymize” such data. That means we irreversibly modify them so that it is not possible to identify a specific person, i.e. such data are no longer regarded as personal data.

The processing time for most of the data is determined by legal regulations. RESIDOMO sets the archiving time based on these regulations.

We process your personal data for purposes defined in the performance of the contract and to fulfil legal obligations and to protect our rights and legitimate interests until the termination of our contractual relationship, or until all related legal matters have been resolved and settled (e.g. outstanding debt, warranty period, disputed billing of services, ongoing legal or administrative proceedings, etc.) and for the period of limitation or statute of limitation.

Personal data that we process based on your consent are stored for the duration of your consent. In order to prove the issuance of your consent, duration, change or revocation, we retain your consent while it remains valid and for 10 years after its termination.

 

Do you have to provide us with your personal information?

Processing of personal data based on a contract and based on our legitimate interest or fulfilment of legal obligations is necessary and without providing these data the relevant service, performance or activity cannot be performed. The provision of this personal data is mandatory and cannot be substituted through any other way.

If you do not want or cannot provide us with some of your personal information, and if this information is mandatory for the performance of the contract or service, we cannot provide the related service to you.

Certain data are processed only based on your consent. The provision of this personal information is voluntary on your part. You may revoke your consent with the processing of personal data at any time, even for a single purpose where you do not wish your personal data to be processed.

We also obtain some personal information from public sources and registers. Using these sources we are able to verify the accuracy of the provided data or your credibility and creditworthiness.

Recipients of personal data

We process personal data under the scope of our own activities. We may disclose the data to third parties only if required by law or if you give us your consent.

We are required to share your data with various government agencies, but this is always done under the conditions set by the relevant law.

If necessary for the fulfilment of any purposes specified above, we will pass your data to a third party, which is required to demonstrate to us that the level of personal data processing and personal security complies with data protection regulations.

The sole shareholder of RESIDOMO is Fondy Bydleni 3 S.à r.l., L-2419 Luxembourg, 7, rue du Fort Rheinsheim, Grand Duchy of Luxembourg, Registration number: B208075. Data processed by RESIDOMO may be transferred to this partner for internal management purposes. The Company maintains a high standard of personal data protection when processing personal data.

Suppliers

Some of our services are provided through our cooperating entities and suppliers. These mainly includes services in the area of ​​management, maintenance, repair and services related to the management of the housing fund (e.g. construction and building contractors, inspection technicians and chimney sweepers). The activities performed by these entities are carried out in accordance with the concluded agreement defining processing of personal data. Based on our audits and inspections, these entities provide sufficient guarantees and have appropriate technical and organizational measures in place as required by data protection legislation. These data administrators are only authorized to process your personal data for the purpose of carrying out the activities for which they have been authorized. Your consent is not required for activities performed in line with the contract on the processing of personal data, because this processing is based on the relevant agreement and legal regulations.

If someone else is entrusted with the performance of certain activities, in particular relating to proper enforcement of your rights as a tenant, your personal data may be processed under these activities.

What rights do you have with respect to protection of personal data?

We process personal data in a transparent manner, correctly and in accordance with the Data Protection Regulations. You have the right of access to your personal data as well as other rights if you believe that the processing of your personal data is not done correctly.

Do you wish to withdraw your consent?

In cases where we process personal data with your consent, you are entitled to withdraw this consent at any time. Revocation of your consent does not affect your data which were processed based on your valid consent until your consent was revoked.

Right to access personal data

The right to rectify inaccurate data

According to Article 16 of the Regulation you have the right to have inaccurate personal data concerning you and processed by RESIDOMO corrected without undue delay. As part of your contractual relationship, you are also required to report changes to your personal information and to demonstrate that such changes have occurred. At the same time you are obliged to provide assistance to RESIDOMO, if it is established that the personal data processed are inaccurate. Correction is to be carried out by RESIDOMO without undue delay while taking into account existing technical abilities.

Right to deletion/erasure

Pursuant to Article 17 of the Regulation, you have the right to have your personal data deleted unless RESIDOMO demonstrates justified reasons for processing your personal data. Therefore, the right to have your data deleted is not an absolute right and each request for deletion shall be individually assessed by RESIDOMO.

Right to restrict processing of personal data

Based on Article 18 of the Regulation and until the relevant complaint is resolved, you have the right to restrict processing if you feel that the accuracy of personal data is insufficient, or if you doubt or deny the legality of the processing, including the reasons for data processing, or if you submitted an objection against data processing.

 

Right to personal data portability

Pursuant to Article 20 of the Regulation, you have the right to transfer data relating to you and that you have provided to RESIDOMO in a structured, commonly used and machine-readable format, and request RESIDOMO to transmit this data to another administrator. You may only exercise the right to data portability if the processing of personal data is carried out automatically and it is based on your consent or on contractual relationship, for example if RESIDOMO allows data transmissions.

Should enforcement of this right adversely affect the rights and freedoms of third parties, the request for personal data portability cannot be upheld.

Right to object to data processing

Pursuant to Article 21 of the Regulation, you have the right to object to personal data processing which are processed based on a legitimate interest of RESIDOMO, or for the purpose of direct marketing.

Should RESIDOMO be unable to prove that there is a valid legitimate reason for data processing that supersedes your interests (as the data subject), RESIDOMO shall (based on the objection which was assessed as justified) terminate the processing without undue delay.

Right to withdraw consent with the processing of personal data

You are entitled to withdraw your consent with the processing of personal data at any time. Withdrawal of your consent shall not affect the legality of processing performed based on your consent prior to your consent withdrawal. Consent may be revoked in the same way as it was given.

Automated individual decision making, including profiling

You have the right not to be the subject of any decision-making process which is based solely on automated processing, including profiling, which could have a legal impact on you or affect you significantly. Based on the above, RESIDOMO states that it does not perform any automated decision‑making without human evaluation focusing of legal consequences for data subjects.

Personal information

Profiling

 

Profiling refers to any kind of automated personal data processing consisting in using such data to assess certain personal aspects relating to natural persons, particularly for the purpose of defining, estimating, analysing or predicting aspects regarding their work performance, economic situation, health condition, personal preferences, interests, reliability, behaviour, places where they are located, or their movement.

 

Recipient

 

A natural or legal person, public authority, agency or another body or third party to which personal data are disclosed. However, public authorities that may receive personal data in the framework of a particular inquiry in accordance with Member State law are not regarded as recipients; the processing of those data by those public authorities must be in compliance with the applicable data protection rules and according to the purposes of the processing.

 

Data subject consent

Any freely given, specific, informed and unambiguous indication of the will of the data subject which he or she, by a statement or by a clear affirmative action, represent an agreement with the processing of personal data relating to the data subject.

Data administrator

A natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the administrator or the specific criteria for its nomination may be provided for by Union or Member State law.
